Turns out I was listening to the same band. I just watched their making of the album on DVD. I am a huge Neal Morse fan, actually everyone in the band except I wasn't familiar with the main singer (Casey McPherson from a band called Alpha Rev).

It's pop-prog. Reminds me a bit in concept to Asia with concise tunes and a great deal of musicianship.

Yeah, the pop-prog is a good tag. A friend was linking some youtube videos and I liked more than i didn't like. Killer drummer, Steve Morse on guitar... kind of strange not to have heard of it, but I guess I don't really listen to hard music anymore... well hardish, music.
