Here in Italy it's one of the most debated issues about justice.
The pensioner here could be accused to be guilty of "excess in self-defense".
Extremely frequent situation in Italy, unfortunately.

You break into someone,s home with a weapon You deserve what you get, Everybody worried about the rights of a criminal Nevermind he was armed and Fixing to streal what he could from people that had worked hard to get the stuff. They should give the man a reward for cleaning up the street scum and saving others from harm and getting ripped off. Let them come to my place I have two German shepherds that would love to play with them

Yes i agree , having a new car pinched from my house, after they broke into my house , i am totally with the guy , when the police located the bashed up and wrecked car that was my pride and joy , a blade was fiund in the footwell , presumably for somone who tried to stop them , me !! But we all know what the judge is going to say dont we ??
Yes was thinking about this today. My way of thinking would be if it came to a confrontation with an intruder in your property, i think its right and proper to use more than "reasonable" force. Something like quite a large amount of force would be more appropriate considering you do not know who they are or what kind of craziness they are capable of. I think you would need to incapacitate them for your own safety.
What a pathetic, sad news story. Glad to hear he has been released on bail... and it should be about $1.... or better yet, on his own recognizance I agree whole heartedly with Tim and Mike S and all of you. I have no tolerance for that kind of crap. Home invasions are the ultimate invasion of privacy. I live in the woods off a dirt road and there isn't a close neighbor or even a street light for 3 miles. I have a Belgian Terveren that doesn't like strangers and I keep a .45 auto hanging on my bedpost and "heavier backup" if needed in my closet just a few more feet away. The dogs are my ears and I am their backup. I don't know anybody hardly that doesn't have a firearm in their home in these parts. Maybe that's why there are almost never any home invasions...

The story made it's rounds here in the states (or at least in my FB feed) on the pro-gun sites as the old "give an inch, they'll take a mile" argument. And even in the states there are different rules for self defense. In some states, like Texas, self defense is defense of life and property.
